Equissage Therapy & Accell Animal Healthcare, Divisions of Australian Therapeutic Solutions Pty Ltd ACN 627 762 396)  maintain and operate this website for use by its customers (you).  By using this site, you accept and agree to these terms and conditions, and agree that your continued use of the site is subject to ongoing compliance with these terms and conditions.  Your consideration for entering into these terms and conditions is the provision of the use of the site by us and you acknowledge that such consideration is a valuable consideration.

We may amend these terms and conditions from time to time by notifying you of the amendment.  Your continued use of the Site [www.accelltherapy.com.au] following any such notice will be deemed to be acceptance of such amendments.

All efforts will be made to ensure the accuracy of the information contained within this site however the views of third party comments and statements are theirs entirely and must not be viewed as those of Equissage Therapy/Accell Animal Healthcare.

All transactions conducted on this website and the associated Shopping Cart will be processed in Australian Dollars AUD$.

Personal information obtained from the user of this site will be done in accordance with Privacy. The Privacy Policy can be viewed here.

You must not assign your obligations and rights under these terms and conditions.

These terms and conditions, including any policies or documents referred to in these terms and conditions, are the entire agreement and understanding between you and us on everything connected with the subject matter of these terms and conditions and supersedes any prior agreement or understanding on anything connected with that subject matter.

We may terminate these terms and conditions and your access to the site at any time without notice.  In the event of termination, you must immediately cease accessing and using the site.

We may send any notices under these terms and conditions by email at the email address provided by you. Notice is deemed to be received when the email leaves our computer system.

The laws of the State of Queensland govern these terms and conditions. The parties submit to the non-exclusive jurisdiction of the courts of the State of Queensland and of the Commonwealth of Australia.

Competition Terms & Conditions

Accell Animal Therapy “The Ultimate Pet Wellness” Competition 2023 (“Competition”)

Terms & Conditions

  1. This Competition is being organised and managed by Accell Animal Therapy (A Division of Australian Therapeutic Solutions Pty Ltd) ABN 89 627 762 396 of 29 Resource Street, Parkinson QLD 4115 (“Accell Animal Therapy”) on behalf of Loyalty Pet Treats (“Loyalty Pet Treats”) & Plush Puppy Australia (“Plush Puppy Australia”) and their authorised agents. (“Promoters”).
  2. Participation in the Competition constitutes the entrant’s acceptance of these terms and conditions. Entries must comply with these terms and conditions to be valid.
  3. Entry is open to Australian residents aged 18 years or over, who own or manage one or more horses. Employees and agents of the Promoters and their immediate family members are ineligible to enter.
  4. This Competition is Trade Promotion Lottery based on skill with the best entry as deemed by the judges being the chosen winner.

How to Enter

  1. The Competition commences on Friday 8th  September 2023 at 9:00am (AEST) and entries close 26th November 2023 at 11:59pm (AEST) (‘Competition Period’).
  2. To be eligible to enter the Competition entrants (‘you’ or ‘Entrant’) must be:
    • (a) an Australian resident.
    • (b) aged 18 years or over; and
    • (c) the own at least one pet or manage a pet business.
    • (d) answer all of the questions in the entry form and press the submit button.
  1. To enter the Competition, you must, during the Competition Period, complete the entry form on the Accell Animal Therapy website accelltherapy.com.au/ultimatepetwellness by providing a response in each of the nominated fields (‘Registration’).
  2. A valid entry must complete all required fields in the entry form, provide an answer in one of the 25 words or less fields.
  3. Entries will be received and managed by the Promoter electronically, through the website www.accelltherapy.com.au/ultimatepetwellness.
  4. The winner (the ‘Winning Entrant’) will be shortlisted by the promoter, judged, and chosen by the Director for Australian Therapeutic Solutions and the Promoter judging team between the 27th to 30th November 2023.
  5. The winner (the ‘Winning Entrant’) will be chosen based on complying to all the entry requirements and being the most creative and accurate written entry for the 25 words or less component.
  6. The Winning Entrant will be contacted directly by the Promotor via contact details provided as part of the entry Registration.
  7. Each Entrant may enter this Competition only once.

The Prize

  1. The Competition prize (the ‘Prize’) is made up of the following:

  3. The Winning Entrant will be announced on the Accell Animal Therapy Facebook page,  https://www.facebook.com/accelltherapy/ and on the Equissage Therapy Website www.accelltherapy.com.au on Friday 1st December 2023 at 11.00am (AEST) (the ‘Announcement’) will be conducted at Accell Animal Therapy at 29 Resource Street Parkinson QLD 4115
  4. The Winning Entrant must contact the Promoters to select Prize products where appropriate, to claim the Prize, arrange collection of the Prize or to provide details as to where the Prize is to be sent within fourteen (14) days of the Announcement. Should the Winning Entrant not contact the Promoters within this time a redraw will occur on 31st January 2024, at 11am (AEST) (the ‘Announcement’) at Accell Animal Therapy – 29 Resource Street, Parkinson, QLD, 4115 Australia.
  5. The Prize is non-transferable, exchangeable or redeemable (in whole or in part) for cash.
  6. If the Winning Entrant does not take the Prize or any part of the Prize at the time stipulated by the Promoters, then the Prize or that part of the Prize will be forfeited by the Winning Entrant and cash will not be supplied in lieu of that Prize or element of the Prize. The Promoters accept no responsibility for any deviation in Prize value.

Miscellaneous Conditions

  1. Entering the Competition is free. No purchase of products or services is necessary.
  2. If your details change during the Competition Period, it is your responsibility to notify the Promoters. A request to access or modify any information provided in an entry should be directed to the Promoters.
  3. The selection of the Winning Entrant and any decision of the Promoters in relation to the Competition is final and no correspondence will be entered in to.

The Promoters:

(a) reserve the right to cancel or amend the Competition, the Prize, or these rules at any time without prior notice;

(b) reserve the right to disqualify any Entrant who submits an entry that is not in accordance with these terms and conditions or who tampers with the entry process;

(c) will not be liable for any losses incurred as a result of any cancellation or changes to the Competition.

  1. Subject, where relevant, to any directions given under the legislation regulating the Competition, if the prize is: (i) not collected or addressing given for freight by the Winning Entrant by a date fourteen (14) days after the Announcement or (ii) forfeited for any reason, the Prize will be deemed unclaimed. The Promoters may conduct but are not under any obligation to conduct a selection of a second winner.
  2. To the extent permitted by law, the Promoters make no warranties or representations about the fitness for purpose or suitability of the Prize and are not responsible for the quality or fitness for any purpose of the Prize, or the failure of the Prize to be of merchantable quality. If liability under terms of a legislation cannot be excluded, the liability of the Promoters is limited to re-supplying the relevant goods or services or paying the cost of replacing them.
  3. The Promoters are not responsible for email, internet, computer hardware and software, phone and/or any other technical errors, malfunctions, and delays that may prevent you from entering the Competition, or that interfere with your compliance with the rules of this Competition. You are solely responsible for submitting a valid entry.
  4. You agree that the Promoters are not liable for losses or injuries of any kind resulting from acceptance of the Prize, participation in the Competition, any delay or inability to submit an entry or any act or omission by you or any third parties.
  5. You agree to indemnify and release and keep indemnified and released the Promoters against any loss or damage suffered or any claim incurred by the Promoters arising out of inaccuracies or illegal content contained in your entry submitted or an act or omission by you or a breach of these terms by you.
  6. To the extent permitted by law, the Promoters will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death that is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Competition or your acceptance or usage of the Prize.
  7. If, due to any reason whatsoever, the Promoters become aware after the Winning Entrant of the Prize is announced that the Winning Entrant has not complied with these terms, that Winning Entrant will have no entitlement to the Prize, even if the Promoters have announced them as a winner and that Entrant will be required, at the direction of the Promoters, to return, refund or otherwise make restitution of the Prize.
  8. The Promoters accept no responsibility for any tax implications that may arise from the receipt by the Winning Entrant of the Prize. Independent financial advice should be sought by you. Where the operation of this Competition results for GST purposes, in supplies being made for non-monetary consideration, Entrants agree to follow the Australian Taxation Office’s stated view that where the parties are at arm’s length, goods and services exchanged are of equal GST inclusive market values. All taxes and any other costs related to this Prize not specifically stated within these terms are the sole responsibility of the Winning Entrant.

Privacy

  1. The information that you provide will be used by the Promoters for the purpose of conducting this Competition. By entering this Competition, you consent to the storage of your personal information on the databases of the Promoters and you agree that the Promoters may use this information for future promotional and marketing purposes regarding their products and services that may be relevant to you including contacting you via phone, direct mail, and/or electronic messaging. You agree that Promoters may disclose your personal information to its contractors and agents to assist in conducting this competition or communicating with you. The Promoters and its partners are bound by the Privacy Act 1999 (Cth). General

  1. The Promoters are not liable for any delay or failure in performing its obligations under these terms caused by unforeseeable circumstances beyond its reasonable control.
  2. These terms are to be construed in accordance with the laws from time to time in the State of Queensland and the parties submit to the non-exclusive jurisdiction in that state.
  3. The Promoters have obtained all necessary state-based and territory-based permits required for the conduct of this Competition.
  4. Participation in the Competition constitutes the entrant’s acceptance of these terms and conditions. Entries must comply with these terms and conditions to be valid.
